She has made a great use of different literary devices to describe her realities of war on the frontline whilst she worked as a VAD nursing injured soldiers. Regarding its wider use in exploring ideas about the First World War; it is a primary source and is about her experiences and the feelings that she had undertaken. Therefore we have first-hand evidence to use to compare and contrast against other poetry of the time. Wedderburn Cannan makes great use of nature and environment to describe and illustrate what she had experienced. She starts firstly by describing her transition to getting to Rouen and then speaks of all the young men with their heart breaking mirth; here she describes them as if they are all having fun and enjoying their comradeship. Thereafter she juxtaposes this idea with the train full of wounded who are being transported away due to the travesty presented thenceforth in Rouen. Men who came from darkness and went back to dark again the continuous work that they had only ended once they had passed. This shows that the sheer realities of death were omnipresent in her service as a VAD. She also makes reference to the King, bugles and our island although not to remember and be proud of them although to forget the eveningswhilst the world slips slow to darkness. Finally, she ends on the note that her heart goes out to Rouen and the trains that go from there. The language that Cannan uses within the poem is very emotive and she makes connotations with different things to help us feel what she is going through. For example the voices of the Indians from this quote we can see a deeper understanding into her ideas about World War One. She also constantly repeats and for effect and to act as a list that the idea of there being neverending problems with the sufferings of the men. This is repeated for every stanza except the last and it could also be seen as a way of her being overwhelmed by the situation emotionally and she just goes on letting it all out. The structure remains extremely mechanical and static throughout with thirteen quatrains; this is primarily extremely unusual for a poem and goes with the idea that she has become repetitive. I think that this fits in with the idea that she feels emotionally overwhelmed and thus due to this, she keeps on with this release in chunks. The poem hasnt been blurted out although it has been well thought and written showing that she must be from a well-educated background such as VADs had been. In Rouen, the persona seems to feels a sense of questioning and disillusionment for the purposes of the war. And the agony and splendour when they stood to save the King?. This shows the feelings that they had towards the War and the leaders who were making this siege in Rouen with such bloodshed. To conclude, I believe that Rouen is a good and effective source to use in order to explore the events of the First World War for women VADs such as Wedderburn Cannan on the warfront such as in the city of Rouen. The language and structure link well with her having a rather mechanical style of writing and that idea that she has become emotionally drained and overwhelmed; and that as an educated lady she has no other way to recapitulate these feelings.

Cinderella’s case conceptualized using a Bowenian transgenerational model According to Bowen, one of the pioneers of family therapy, family can be understood as an emotional unit, which can be best analyzed through a multigenerational framework. Cinderella’s story, which was told by many professional storytellers, including brothers Grimm (19 century) and Charles Perrault (17 century), as many other famous fairytales lacks many important details and characters’ descriptions that a therapist would need for administering family treatment involving transgenerational model. If we would speculate knowing some information about Cinderella’s family members, the transgenerational model would work beautifully. A chronic anxiety of Cinderella, her unstable, submissive behavior, could be explained by anxiety transmitted over several generations. Goldenbergs bring our attention to a few important emotional patterns of an individual:†the selection of a spouse with similar differentiation level and the family projection process that results in lower level of self-differentiation† (p. 89, 2008). Bowen would even build a prognosis for Cinderella’s children to have a reduced level of self-differentiation and being increasingly vulnerable to anxiety (Goldenberg & Goldenberg, 2008). Bowen emphasized that the multigenerational transmission programs not only the levels of self – differentiation, but also programs family’s roles and interactions. Cinderella’s marital problems could be understood very well through the lens of her family behaviours (The Bowen Center, n. d. ). My only major concern about application of transgenerational model in Cinderella’s case would be the early death of Cinderella’s parents ( her genogram is hard to build) and her latter life with the wicket, very directive stepmother, who evidently influenced Cinderella’s fragile and indecisive mind structure. Cinderella’s ability and inability to build attachments to her family members, which were not all â€Å"angels†, should be also considered when providing her with a therapy. Once again, her attachment to her loving father, her godfairy, her stepmother and stepsisters, could be easily incorporated into transgenerational model. Cinderella’s case conceptualized through Bowen’s concepts of triangulation. According to Goldenberg and Goldenberg (2008), the Bowen’s concept of triangulation would allow understanding better Cinderella’s marital problems. Probably, a few first years of Cinderella’s marriage were happy, because it was a big relieve for her to escape the stepmother cruelty. However, even her first marital years could have some initial problems. For example, the prince, who was brought up in a â€Å"normal† family, could not understand or could not believe Cinderella’s stories she told about her family. He would smile when she would share her violent memories with him. The prince mistrust and his ironic smile could initiate some negative feelings and despair in Cinderella. In this case, the stepmother’s figure would be present in Cinderella-prince conflict through Cinderella’s stories. It is particularly interesting that the third person does not need necessarily be present to create a conflict in triangulation (The Bowen Center, n. d. ). When children were born from a person (or two persons) with low self-differentiation, many other triangles and possible shifts and tensions could occur. Cinderella’s case and the object-relations model Goldenberg and Goldenberg (2008) provide a deep insight into Cinderella’s story based on the object-relation model, which is connected to the early Freudian concept of mother-child bonds. Even though the Cinderella’s relationship with her mother was very short before her mother past away, it appeared to be a foundation of many Cinderella’s later issues, such as her idealization of some women characters (godmother; later, some older women-friends), a few conflicts between her ego and id, suffering from deprivation of early attachments, developing insecurity and low self-esteem, and others. All these issues that the object-relations model would discover, could be projected to Cinderella’s later marital problems. A person who survived a trauma of loosing her both parents and the hardship of living with evil stepmother and stepsisters could have a lot of troubled thoughts and experiences that could be projected into her relationship with her spouse and children. I believe that the object-relations model (psychodynamic in its core) could provide the best insight when dealing with Cinderella’s marital problems.

Battle could be won or lost depending on information aquired from spies. Back then, spying was hardly the same as it is today, with all of our high-tech gadgets and well-organised secret agent groups. However, most of the things that spies do today were done in the nineteenth century just as effectively. On thing that spies did was send messages, which were usually about the enemy's plans and movements, their troop size, their supplies, and the placement or strength of their forts. Many used coded messages with words that stood for different words. Some had different symbols for letters and numbers. Some spies even used inivisible ink. The spies also had ways of concealing the messages that they had to deliver. Messages were often hidden in articles of clothing. People had to write on silk, that was then sewn into clothing, and spies could also hide information in large metal buttons. Women's clothing was ideal for hiding things in. Ancient Traders and Merchants of Mesoamerica A strong market economy was a very important aspect of Mesoamerican cultures. Although much of our information about the market economy in Mesoamerica comes primarily from the Aztec/Mexica world during the Late Postclassic, there is clear evidence that markets played a major role throughout Mesoamerica in the diffusion of goods at least as recently as the Classic period. Further, it is clear that merchants were a high-status group of most of the Mesoamerican societies. Luxury Goods for the Elites Beginning during the Classic Period (AD 250-800/900), merchants supported urban specialists with raw materials and finished goods to convert into luxury goods for the elites, and exportable items for trade. Specific materials traded differed from region to region, but, in general, the merchant job involved acquiring, for example, coastal items such as shells, salt, exotic fish and marine mammals, and then exchanging them for materials from the inland such as precious stones, cotton and maguey fibers, cacao, tropical bird feathers, especially precious quetzal plumes, jaguar skins, and many other exotic items. Maya and Aztec Merchants Different types of merchants existed in ancient Mesoamerica: from local traders with central markets to regional merchants to the professional, long-distance merchants such as the Pochteca among the Aztecs and the Ppolom among the lowland Maya, known from Colonial records at the time of the Spanish conquest. These full-time merchants traveled over long distances and were often organized into guilds. All the information we have about their organization comes from the Late Postclassic when Spanish soldiers, missionaries, and officersimpressed with the organization of the Mesoamerican markets and merchantsleft detailed documentation about their social organization and functioning. Among the Yucatec Maya, who traded along the coast with large canoes with other Maya groups as well as with Caribbean communities, these merchants were called Ppolom. The Ppolom were long-distance traders who usually came from noble families and leaded trading expeditions to acquire valuable raw materials. Probably, the most famous category of merchants in Postclassic Mesoamerica, though, was the one of the Pochteca, who were full-time, long-distance merchants as well as informants of the Aztec empire. Greywater recycling is the waste water generated from washing machine and dishwasher is used for other stuff. The greywater can be used for cleaning the house compound, flushing toilet and many more. So, never pour water down the drain when there may be additional use for it for example watering a plant or garden, or for cleaning. This can be done by while taking showers, place a bucket in the showers to catch excess water and use the water for cleaning or flushing the toilet. This can be apply when washing dishes or vegetable in the sink. Next, it would be turning off the main water valves when it is not in used. As during water shortage, water is very limited. Thus when the local officials advice on the water rationing, it is better to off the main water valves to prevent those already in the tank is contaminated. Apart from that, during water rationing, it is best to repair broken or leaking pipes. This is to prevent extra water being wasted unnecessarily. This can be done by repairing dripping faucets by replacing their washers. Another method is to check for toilet tank leaks by adding food colouring into the tank. If the toilet is leaking, colour will appear in the toilet bowl within 30 minutes to an hour. It is good to check the toilet for worn out, corroded or bent parts. Most of the replacement parts are inexpensive, readily available as well as easily installed. During shower, it is better to take shorter shower instead of long bath. Replace the showerhead with ultra-low flow version. Some of the ultra-low flow version allows users to cut off the flow without adjusting the water temperature knobs. In the shower, turn on the water to get wet and turn off after the body is wet then turn back on to rinse off. Repeat it when washing the hair too. Avoid flushing the toilet unreasonably. Throw of tissues, insects and other related waste in the dustbin rather than the toilet bowl. For the lawn, do not overwater the lawn. As a general rule, lawns only need watering every five to seven days in a week. Heavy rain will eliminate the need of watering for up to two weeks. If possible, do buy a rain gauge and use it to measure the rain that land on the lawn. Water lawns during the early morning hours when temperatures and are the lowest. This reduces water losses from evaporation. Another method is having bigger water storage. With less water used on days when the water is rationed, it is best to realigning the use of fresh water. Having extra storage in the house will be good if water rationing period is extended for a day or two. If the water storage is on the roof, it had to be big enough to store water for drinking, bathing and cooking. Recommendation to the Causes Identified There are a lot of steps that can be taken to solve water shortage issues. One of them is rainwater harvesting system. Rainwater harvesting system will cut down the usage of treated water used for car washing, toilet as well as general cleaning. This will save up on the water bills. One huge problem is finding sufficient space for the rain water harvesting system to be installed. It is not a small piece of device that one can just plug and play. Another recommendation for water shortage is desalinization. Desalinization is system which can filter the salty water through membranes and removing the salt through electro dialysis and reverse osmosis process. Meter is the fairest way to charge for water and the people need to be held responsible for what they use. For example, a family of four uses as much water in a day as a sprinkler uses in an hour. If people are using sprinkle and swimming pool, they need to pay extra. Apart from that, the government should persuade and educate people to use less water. Small actions like turning off the taps during washing up could save a lot of water. For example, by turning off the tap while brushing teeth would save a lot of water. If a normal tap runs at five litres a minute, people do brush their teeth for two minutes for twice a day. It would be 20 litres that goes down the sink. Another method is by charging the water based on the water quality. A raw water quality based raw water tariff should also be in place to ensure the governments are receiving income by safe guarding the water catchment areas to secure raw water resources. Safe guarding water catchment areas will preserve the raw water quality and reduce cost of treating water which will be translated to affordable water tariff. Conclusion In conclusion, stopping water crisis from reaching tragic level needs more concern of people as well as governments. It can be an effective ways to increase consciousness among all people from all walks of life regarding the shortage of water and what people have to face in the future if the uncontrolled water usage is not stopped. English 2 – Literary Response

My Singular Irene Literature is, by my understanding, a means to critic society and individuals or the way the world is behaving. Writers of Literature write literature to provide a new way of seeing things that might be different from our point of view. In other words, writers use tools of literature story like: symbolism, point of view to help them is making the literature story to be more exciting and clear to us, the reader. The author helps us to see the frailty or other bad deeds and good things about this life in this world as we seldom see those things with our own eyes. A Very Old Man With Enormous Wings and My Singular Irene is a very good example for this literature reading, because it is very rich in literature concept and devices, like: symbolism or point of view. The main character in this story is said to be alienated, repressed and silenced in the story. I will prove this statement by retelling the main point on the story that supports this statement. A very old man refers to an old angel that is cast ashore into earth because of inability to keep up with the heavy rain. e can see that the angel is alienated from examples that shown this statement, such as : †They found the whole neighborhood in front of the chicken coop having fun with the angel, without the slightest reference, tossing him things to eat through the openings in the wire as if he weren’t a supernatural creature but a circus animal. †(Gabriel Garcia Marquez 36). the angel is alienated because It is treated differently from the others. The others are having f un with the angel rather than socializing with the angel. The angel is also repressed and silenced. There is a quotation that shows this statement: â€Å"Pelayo watch over him all afternoon from the kitchen, armed with his Bailiff’s club, and before going to bed he dragged him out of the mud and locked him up with the hens in the wire chicken coop. †(Gabriel Garcia- Marquez 36). From this statement, we can derive that the angel is â€Å"caged† from it’s freedom and its freedom is repressed by the caged that Pelayo given it, thus the angel is silenced from the freedom. My Singular Irene is also a good example for this literature reading. Irene is reputed to be alienated is true in this story. Irene is treated differently from other people. From the story we know that Ilene’s husband( the first person view in the story) isolated Irene from the outside world by buying Irene very expensive â€Å"stuff† to lure Irene to stay in the house isolated from the outside world. Irene is also axiomatic to be repressed and silenced. We know from the story that Irene is considered as a â€Å"thing† to her husband, because her husband wants Irene to act like he wants. So, in order to satisfy his ego, Irene is inhibited and muted by many ways, like: not allowing Irene to go to the outside world, forbidding visitors to meet Irene. Irene too, like the Angel is constrained from freedom. A Very Old Man With Enormous Wings and My Singular Irene are an example of story that has a symbol of contemporary alienation and triumph over it. First, I am going to express about A Very Old Man With Enormous Wings. The angel in the story is alienated or make indifferent. It is derived from the behavior of the people that found the angel. It is treated like mere goods than divine figure. So, it is true that it is a contemporary alienation. Later in the story, we know that the angel has his most precious tool that can bring him back to his divine status. That tool is its wings, when its wings grows back, he immediately leaped up to the sky and clapped its wings and fly to the horizon of freedom. The angel is reputed to be a triumph over alienation. Second, My Singular Irene is also a symbol of alienation. Irene is also made hostile like the angel. She is isolated or â€Å"caged† by her husband; there is an interesting point in this story in my point of view. To me, Irene seemed to be speechless or not a living thing. The author writes the story in such a way that us, readers, grabs the alienation theme in the story. Irene is also considered as a triumph over alienation. There is a quotation from the story: Horrifying! Irene changed into a horrendous butterfly! I stood up and fell again, powerless now. She would leave me; she would take flight and leave me. The gigantic Irene Butterfly smiled at me, diminished, and disappeared with the others. I am at the site of the events, waiting for Irene’s return. She has no return. She cannot deny me the peace that her company always offered me. (AlmAnzar, JosE AlcAntara 45) From this quotation, I interpret it that Irene’s freedom does also mean she has a higher status in the relationship with her husband now. What I meant by higher status of relationship is the one that always try to get the relationship going is the one that has a lower status, in this case, her husband. Irene’s triumph over alienation is expressed by the author of Irene transformation into the most beautiful butterfly that can fly anywhere it wants. It is very interesting that these two stories have a similar thing. They both define freedom by flying leaving the thing that binds their way to freedom. The following paragraph below tells a story about human needs for personal freedom and community. There is certainly no argument in this world that can be used to defy human needs for socializing and personal freedom. Human always seek out a way to grab that freedom. Kingdom falls, kingdom rises, Leader of a faction dies, and assassin was born. All of these examples are made because of the need to obtain and maintain personal freedom and the ability to communicate freely with communities of choice. There is an interesting story below those talks about human’s desire for personal liberty. This story is about the struggle of African-American communities in the United States to obtain their right of personal freedom and human needs for sociality. United States also known as the land of the free and the brave has been well known for its freedom. It has a lot to offer, such as: the freedom of speech, the right to work, etc. But, in contrast to all of those things, there is a little dispute inside this great country in the era of slavery. African American is the target for this matter. African American arrived in the United States as Indentured Servants via Jamestown, Virginia in 1619. They could earn their so called â€Å"personal freedom† by working as slave to their chosen master. As time goes by, the other majority in the United States made a conduct for slaves called â€Å"Slaves Codes†. This Slave Codes constrained African American in the Unites States from their liberty. They did fight for it until the Majority pushes another harsh rule for any slaves that disobey its masters. From this point, we can see human’s needs for personal freedom. Human fights for freedom risking everything they had, like: their lives, treasure, relatives. There is also a story of a president that fight for part of his citizen’s needs for personal freedom, his name was Abraham Lincoln. He was a farmer boy that born Feb. 12, 1809, in Hardin County, Kentucky. His parents were both born in Virginia. Abraham was well known for his strength and cleverness in farming skills. In not so long time he began to be very famous in the community because of his skills in socializing. Not so long after that, he became the president of the United States. He saw this great calamity of slavery and intends to abolish this calamity for good. To pursue this personal freedom, Abraham had gone through a lot of obstacles from his own family until his own citizen in the south. Alas, not so long a civil war broke out between the north and the south. But, the good always wins; Abraham with the North wins the Civil War by diplomacy. And thus the period of reconstruction began. Unfortunately Abraham was killed by an assassin in April 14, 1865; Lincoln was killed at Ford's Theatre in Washington by John Wilkes Booth. This story has greatly described to us the importance of human need for community and personal freedom. In conclusion, these two stories, My Singular Irene and A Very Old Man With Enormous Wings, tell us about the importance of personal freedom and need of interaction with other people. They also told us, no matter how hard human is pushed to abandoned their personal freedom; human always emerges to fight their way to obtain freedom even though they have to put their lives on the line to achieve their goal, personal freedom.

Gammasonics Institute for Medical Research Pty Ltd

Gammasonic v Comrad[1] demonstrates the reluctance of the courts to interpret the Sale of Goods Act to include software downloads as a â€Å"good†, preferring to leave the matter up to statutory review. It primarily discusses whether a software package delivered by online download is effectively classed as â€Å"goods† for application of Sale of Goods Act[2] and outlines the progressive court decisions that have considered the question and have begun to recognize software attached to a medium, like a cd package as a â€Å"goods†. It also briefly addresses the applicability of statutory warranties of fitness for purpose and merchantable quality and supports that fitness for purpose and merchantable quality are implied by common law giving reference the test for implication in fact outlined in BP Refinery (Westernport) v Shire of Hastings (1977)[3] Background and overview The disputing parties are Gammasonics, a provider of services to radiologists in NSW, and Comrad, a business that provide software and information management systems to radiologists in Australia and New Zealand. The dispute concerns a contract between the parties for the delivery and installation of a software package via remote internet download called â€Å"Comrad RIS†; which was to manage workflow, patient registration and appointments, online referrals and processing of Medicare claims for Gammasonics. The software was downloaded onto Gammasonics’ server and Gammasonic were purportedly responsible for hardware configuration and the network infrastructure specified to run the software. Comrad delivered the software via internet download and certain areas of the software did not function as required. Gammasonics claimed to terminate the contract for breach of terms including â€Å"failure to deliver a functioning software package, failure to provide goods of a merchantable quality and/or for the delivery of a software package which was not fit for its intended purpose.† [4] Comrad in turn sought an award for damages due to the repudiation of the contract by Gammasonic. Trial Proceedings This case is an appeal from Local Court against orders made by Magistrate Quinn in favour of Comrad for the amount of $58,011.21. There Magistrate Quinn was not convinced the software supplied by Comrad was a â€Å"good† as defined in s5 of the Sale of Goods Act 1923[5] and â€Å"held the act did not apply†[6]. She also found Comrad failed in the delivery of certain components required for the software functioning; however it was stated that it was â€Å"Gammasonics' own acts or omissions and not any conduct for which it had contractual responsibility that rendered the system unworkable, such that Gammasonics’ purported termination was a repudiation of the contract thereby entitling Comrad to sue for damages.†[7] Material Issues The following are the key issues that arise from the judgement and contain the essential elements of the case which will be discussed in this case note. 1. Whether a software package delivered by online download is effectively classed as â€Å"goods† for application of Sale of Goods Act.[8] 2. Whether equivalent terms of fitness for purpose and merchantable quality are implied by common law. 3. Breach of essential terms The matter of whether a breach of contract is a question of mixed fact and law is also addressed in this case but it will not be extensively discussed within this case note. Whether a question of mixed fact and law arises was dealt with early in the case and Fullerton J was satisfied that the question of whether her Honour erred in holding that Comrad was not in breach of the contract, involved a question of mixed fact and law and as such leave to appeal ought be granted. Comrad also filed a notice for contention on two points one concerning the implication of terms into the contract equivalent to the statutory warranties of merchantable quality and fitness for purpose, the other on the question of breach. The Sale of Goods Act 1923 The definition of goods provided in the Sale of goods Act 1923 (NSW) s5(1) is Goods include all chattels personal other than things in action and money. The term includes emblements and things attached to or forming part of the land which are agreed to be severed before sale or under the contract of sale. It was submitted by Gammasonics that the software provided by Comrad was within the statutory definition of â€Å"goods† and they relied among other things on the implied condition as to quality or fitness in the act outlined in s19.[9] On appeal a request was made to consider whether there was a â€Å"Fresh Analysis of Authorities†[10] with a more modern approach to interpretation of the Act. Whether a software package delivered by online download is effectively classed as â€Å"goods† for application of Sale of Goods Act.[11] The case gives a thorough analysis and contains a comprehensive list of authorities that include case law and secondary sources which have reviewed this question. The key area of difference noted was that the software was delivered by download onto a server. This distinguished the case from that of others including Toby Constructions Products Pty Ltd v Computa Bar (Sales) Pty Ltd[12] where the software was held to be a ‘good’ because it comprised both software and hardware. Gammasonics relied on a passage from Advent Systems Ltd v Unisys Corp [13] as authority where an analogy was drawn to musical compositions and music on cds suggesting that once the software had been downloaded to the server it became a tangible thing. However the common thread is that software provided on a disc falls within the statutory definition of a ‘good’ while remote download via a license it appears currently does not. The case Fullerton J considered most analogous to the facts was St Albans City. [14] In this case the question of whether the transfer of the software, without the sale of the disk would give rise to a sale of â€Å"goods† under the Sale of Goods Act 1979 (UK) was considered by Sir Glidewell. There the disk was likened to an instruction manual however again the distinction is made between the delivery of the software via disk format and remote download a distinction that was also noted by Sir Glidewell. An Australian case that revisted the question was Re Amlink Technologies Pty Ltd and Australian Trade Commission[15] this case did not follow the reasoning offered in St Albans City[16] by Sir Glidewell and considered the proposition taken to the extreme would see goods being defined in areas that where never meant to be covered by the act. Secondary sources were further considered as Gammasonics highlighted what they supported to be a ‘growing trend’ in Australia to recognize software as a ‘good’[17] The recent Trade Practices Law Journal article by Svantesson discussed the stages of development citing Toby Constructions[18]as the first step taken in recognition of software sold together with hardware as a good. The article also highlighted the decision in Amlink Technologies[19] to recognize software attached to some physical medium and suggested the next logical step for the courts was to further recognize software not attached to a physical medium. A passage from a conference paper was also considered[20]where the distinction is made that where a customer purchases a digitized version of an encyclopedia it is a good however where it purchases access to the encyclopedia database it is a supply of a service. The facts of this case are most like that of the first scenario and the plaintiff submitted that the authorities support the conclusion that the software provided by Comrad is a ‘good’ under the act[21] It fell however to the principals of statutory interpretation in particular the everyday meaning of goods and possession. Comrad submitted that the ordinary meaning and any interpretative words referred to things that are tangible; therefore, â€Å"because lines of computer code are intangible the position contended for by Gammasonics was inconsistent†.[22] Fullerton noted that it was preferable to give protection to consumers purchasing software by digital download and noted that research suggests that this is an increasing form of delivery means but stressed the need for legislative reform[23] in the area not judicial intervention and found that the Sale of Goods Act did not apply. Whether equivalent terms of fitness for purpose and merchantable quality are implied by common law. The case also outlines that common law terms as to fitness for purpose and merchantable quality can be implied. This is in accordance with test for implication in fact [24] from BP Refinery (Westernport) v Shire of Hastings which is: 1) it must be reasonable and equitable; (2) it must be necessary to give business efficacy to the contract, so that no term will be implied if the contract is effective without it; (3) it must be so obvious that â€Å"it goes without saying†; (4) it must be capable of clear expression; (5) it must not contradict any express term of the contract†. Although the test was ultimately not considered. Breach of Essential Terms With regard to the breach of essential terms two main areas were readdressed. The interfacing with Medicare and network incompatibility. In both cases the documentary evidence was reviewed. While the plaintiff submitted that the findings of the Local Court were in error and that Comrad was responsible for both resolving the problems of interfacing with Medicare and for creating the interfacing problems. Comrad failed to provide sufficient evidence to support these claims and Fullerton J was not satisfied that Quinn J was in error therefore the appeal was dismissed. Effect on Current Law This case has been referred to in a recent journal article discussing when ‘software is a good’.[25] It has also been referenced in the recent edition of Australian Commercial Law[26] as the authority for the principal that software delivered online does not constitute a good, within the meaning of the Sale of Goods Act[27]. The case highlighted the need for legislative review in regard to the status of computer software and with the introduction of new legistlation The Australian Consumer Law (ACL) it has finally been decided that for the purposes of the ACL software is now specifically included within the definition of goods [28] affording consumers protection under s54 Guarantee as to acceptable quality[29] and s55 Guarantee as to fitness for any disclosed purpose.[30] It also shows the courts reluctance for judicial intervention on matters that may have wider applications in the interpretation of legislation and illustrates the progressive nature of the courts to effect change.
